Restructuring Senior Associate

A restructuring lawyer, provides legal advice and representation to clients facing financial distress, including both debtors and creditors. Likewise, a restructuring lawyer educates funds and PE firms in workouts and/or restructuring schemes to preserve value through recovery or enforcement, as well as to mitigate impacts when value is closed to 'zero'. The role encompasses both contentious and non-contentious matters, such as negotiating debt repayment plans, restructuring plans, workout schemes, driving recovery plans and handling fully-fledged insolvency processes and liquidations/winding-up processes.

Main duties and responsibilities

  • Advising Clients: Providing legal counsel to clients on restructuring options, including debt refinancing, debt rescheduling, restructuring plans, workouts, and/or formal insolvency procedures.
  • Negotiating and Drafting Restructuring Plans: Negotiating with debtor/creditors to agree on new repayment terms and drafting legal documents like restructuring plans. Likewise, a restructuring lawyer shall be ready to challenge restructuring plans when advising creditors/equity, or otherwise providing legal arguments to the Court when representing companies/groups and the plan devised is challenged.
  • Insolvency Litigation: Handling legal disputes related to restructuring and insolvency, including enforcing lender's securities, in and out-of-court, and navigating complex legal proceedings.
  • Debt market: Handling transactions and delivering advice as regards secondary markets and securitization, focusing on NPLs primary or secondary market deals (whether representing sellers or buyers, in the shape of NPL/REOs portfolios or 'single names' transactions)
  • Market Research and Opportunity Identification: Identifying potential restructuring/distress opportunities and developing strategies for clients to take advantage of them.
  • Client Communication and Relationship Management: Maintaining strong client relationships, communicating complex legal concepts clearly, and collaborating with other legal and advisory teams.

About you

  • Have at least 9-10 years of experience in the areas mentioned before.
  • English and Spanish advanced level
  • Commercially oriented, budget-wise, client-focused and ability to surpass expectations.
  • Ability to analyze complex legal and financial information and identify potential solutions in a clear, straight-forward, simple fashion, producing deliverables timely.
  • Able to handle multiple priorities, working to sometimes conflicting timescales in a fast-paced and challenging environment
  • Able to build trust and rapport to develop effective relationships, internally and externally
